1. Introduction

We believe that trust is fundamental to our customer relationships and are committed to upholding the highest standards of data privacy and security. We collect and process information complying with all applicable data protection laws. We do not share or use your information for any other purpose than providing Insurance products and services and we will not sell your data.

Fairmatic is offered through a licensed surplus lines broker, Straight Up Insurance Services, LLC (California License #0L02394).

This Privacy Policy explains the privacy practices for Straight Up Insurance Services, LLC’s (“Fairmatic,” “Company,”“we,” “us,” or “our,”) website, www.fairmatic.com (the “Site”) and for the products and services offered to you through our family of sites, or through applications on mobile devices (collectively referred to as the “Services”).  

This Privacy Policy explains how we collect, use, share and process your data. By using or accessing the Site or Services or by submitting information to Company, you consent to the terms of this Privacy Policy.

2. Applicability of this Policy

This Privacy Policy applies to both (a) entities that sign up or contract directly with Company for any of the Services (referred to herein as “Client,” “Clients,” “you,” “your,” “user,” and “users”) and (b) individuals and entities whose information and data is provided to or collected by Company directly or indirectly through its Services, affiliates of Company (collectively referred to as “Affiliates”), and clients of any Affiliates, for example, fleet owners or drivers who work for or are customers of a social transportation network, an insurance company, or another business; and (c) visitors to the Site.

This Privacy Policy applies only to Fairmatic’s information-gathering, use, and sharing of Personal Information in connection with our Services. This Privacy Policy does not apply to any of our information practices conducted separately by Company affiliates or by the Company’s Clients. We encourage you to read and understand the privacy policies that govern our affiliate's and Clients’ use of Personal Information.

3. How We Collect Information

To provide you with our insurance product services, we will collect and process information through the usage of our product, services, and interactions with our Business.

If you provide information about another individual to us or our affiliates, you represent that you have the authority to do so, delivered the required notices, obtained all necessary rights, and permit us to use the information in accordance with this Policy. If you believe information has been provided to us improperly, please notify us under the "How to Contact Us" section below.

Information you provide to us

We receive Information when you voluntarily provide it directly to us while using our products. For example, when you register for an account, request information or support from us, request a quote, send us feedback, or submit job applications, etc.

  • Contact Information, such as name, phone number, email address, employer, company name, and address
  • Driver & Vehicle Information such as employment history, date of birth, driver's license, Social Security Number, automobile information, Motor Vehicle Reports (MVRs)
  • Third-Party Information, i.e the information you provide about another individual in relation to the use of the services, such as their contact information, social security number, driver’s license, and any other information to comply with legal and regulatory obligations
  • Company Information, information and documentation relating to you and your company, and payment information, signature, telephone number, billing contact, and address for invoicing
  • Communication and Content, which includes data, text, files, software, graphics, audio, photographs, video, messages, and communications sent via email, web, or mobile channels when interacting with the service, asking for support, or providing feedback. This includes information needed to service claims such as Insurance policy details, medical and financial information, employment history, etc which may include information about you and your business
  • Job Application Data, such as your employment and education history, written material, references, and information necessary to consider your application

An employer, agent, or broker may also provide this information to Fairmatic. We may also receive Information about you from a business or commercial partner. For example, we would receive Motor Vehicle Reports on individual drivers as part of the insurance agreement.

Information that we collect

We generate, collect, and derive information when you use and interact with our products and services:

  • Service Usage, which includes information and metadata about your usage of our web and mobile products, such as the time and date of your activities, feature usage, page views, login, and debug information
  • Telematics Data, Information on driving activity through mobile and other sensor data, such as driving speed, driving behavior, phone usage, vehicle class & type, location, and similar information
  • Device Data, which includes information about the type of device or browser you use, your device's operating software and settings, and device identifiers, such as IP address and other identifiers
  • Geolocation Data, which is location information provided by the device or phone when using our Service

Like many websites and online services, we may use cookies and similar technologies to help us provide and improve the Services for our users:

  • Cookies are small files stored on your devices that uniquely identify your device. We use cookies to make it easier for you to use the website, personalize your experience, and support security features. For more information on our use of cookies please see the “Use of Cookies” section below.
  • Log Files record events when using the Services to help us to debug and resolve support issues
  • Web Beacons are small code embedded in a website, email, or application that helps us track usage and interactions that allows us to provide you with better functionality.
  • Device Fingerprinting, analyses and combines small pieces of data from your device to create a “fingerprint” and uniquely identify your device or application on your device which enables us to personalize our services.
  • Software Development Kits (also referred to as SDKs) are software tools used by developers to interact with a third-party platform.

Information Collected from Other Sources

We also collect and receive information from other sources:

  • Government agencies, such as the Department of Motor Vehicles (DMV) for information about the Driver, Driving history, Loss History, Vehicle information, etc
  • Third-Party Administrators (TPA) to process information necessary to manage Insurance claims
  • Agents, Brokers and Partners for Credit Reports, Loss history, Company and Financial Information, Employment History, and other information needed for the insurance application process
  • Service Providers, which help us operate our Business.
  • Payment Processing Partners for Billing, Invoicing and provide or support the delivery of financial services
  • Financial and Business Information providers, Employee Background Checks, and Compliance Monitoring, which help us understand your business, maintain security, and comply with regulatory requirements.

4. How We Use Information

We use the Information for business and commercial purposes as per the practices described in this Policy, and to operate our Products and Services:

  • Providing and Maintaining Insurance Products and Services, enabling your use of the Services for Insurance such as underwriting policies, determining risk factors, analyzing driving behavior through traditional and telematic means, developing Artificial Intelligence (AI) Machine Learning (ML) risk models, calculating premiums and billing, provide value-added safety and fleet services, facilitate handling of claims, addressing technical issues, and analyzing usage and activities.
  • Developing and Improving Our Business through an understanding of how you access and use the Services, surveys, analytics, market research, and personalized user experiences and recommendations.
  • Communicating with you for user support, handling queries, sending product and marketing or promotional newsletters, and gathering feedback via email, phone, or video calls.
  • Security and Safety by conducting fraud and threat analysis, addressing security or technical issues, protecting the Company’s rights, detecting and preventing spam or unlawful or abusive activity, investigating suspicious activity, monitoring Cyber Security, and breaches of policies and terms.
  • De-identifying or Aggregating information by masking or removing information that could identify you, and aggregating by combining it with other information. Such information may be used to develop models using Artificial Intelligence (AI) or Machine Learning (ML) algorithms that cannot be used to re-identify an individual.
  • Compliance with legal obligations, we may process your information to comply with applicable laws, rules and regulations, and contractual obligations, including cooperation with government authorities,  regulatory mandates, or court orders.
  • At your request if you direct us to process information to fulfill a purpose or expressed through the use of Services, for e.g. processing vehicle information for improved fleet management experience
  • With your consent to use information in any other manner, or for any other purpose, for which you have given permission or consent to the Company.

Additionally, we may use information that does not identify you for any purpose permitted by law or contractual obligation applicable to us.

5. When and with whom we share Information

We share and disclose information collected only as compatible with the purposes described in this Privacy Policy and as permitted or required by applicable law. You are responsible for ensuring the legal basis for processing and obtaining any required consent from any individuals whose Personal Information you provide to Fairmatic. Information is shared with or disclosed to others as follows:

  • Contractors, Service Providers, Affiliates, and Agents. We disclose information to companies and individuals we employ to perform functions or services for Company or otherwise process information on our behalf. For example, assisting with the delivery of Service, such as cloud infrastructure, hosting services, analyzing data, telematics providers, technical support, and marketing assistance. We contractually ensure that the information is only used for the purposes for which the third party has been engaged by us, and to provide adequate protections that are no less protective than those set out in this Privacy Policy. We may permit these third parties to use non-identifying information, including de-identified or aggregated information for any purpose except as prohibited by applicable law or contractual obligation. We are not liable for the acts or omissions of these third parties, except as provided by applicable law.
  • ‍Compliance with Law and Protection of Company and Others. We reserve the right to disclose personal or non-identifying information when we believe release is appropriate to comply with the law, judicial proceeding, court order, subpoena, or other legal processes; detect, prevent, or otherwise address fraud, security, emergencies or technical issues; enforce or apply our terms of use, terms of service and other agreements, rights and remedies; or protect the rights, property, life, health, security and safety of Company, our employees and contractors, our users, or anyone else. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction purposes.
  • ‍Business Transfers and Collaborations. As we continue to develop our business, we might sell the Company or its business or assets or sell or buy online sites, services, subsidiaries, or other businesses; or we might collaborate or partner with other companies in strategic transactions, business arrangements or licenses. In such transactions, customer and user information and information regarding usage of the Service generally would be one of the transferred business assets or otherwise one of the components of, or involved in the transaction; we may therefore share this information in connection with such transactions or arrangements.
  • ‍At your request to disclose information per your direction.
  • ‍With your consent to otherwise disclose information after obtaining your consent to do so.

Additionally, we may disclose information that does not identify you, including de-identified or aggregated information for any purpose permitted by law or contractual obligation applicable to us.

The Services may also enable you to directly send or receive information from third parties, such as an employer or an insurance broker. The use, storage, and disclosure of such information by these third parties are subject to their own privacy policies.

6. How Long We Keep Your Personal Information

We retain each category of Personal Information for the period that is reasonably necessary to fulfil the purposes for which it was collected as outlined in this Privacy Policy, and as necessary to comply with our legal obligations, resolve disputes, prevent fraud, and enforce our agreements.

We may also retain Information that is de-identified or aggregated such that it does not identify you.

7. Security of Your Information

We use appropriate, industry-standard security measures and technology to protect information covered by this Privacy Policy (excluding publicly disclosed information). In this regard, we employ organizational, administrative, and technical measures designed to protect your Personal Information from unauthorized access and disclosure; and safeguard against loss, theft, misuse, alteration, and destruction. However, no method of security is 100% secure.

Even though the Company has taken reasonable commercial steps and efforts to prevent personal information and other information covered by this Privacy Policy from being accessed, used, intercepted, or disclosed by unauthorized individuals in violation of this Privacy Policy, by using the Services, you acknowledge that the Company cannot fully eliminate security risks associated with your information.

We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of unencrypted electronically stored personal information (as defined in applicable statutes on security breach notification) to you via email or conspicuous posting on or through the Services in an expedient manner and without unreasonable delay, insofar as these are consistent with (i) the legitimate needs of law enforcement, (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system, and (iii) applicable law.

Children’s Privacy

Fairmatic does not knowingly collect personal information from any person who is under the age of 16, unless there is some lawful purpose to do so, for example, to facilitate the handling of a claim involving a person under the age of 16. Changes to this Policy

This Privacy Policy may be updated or modified from time to time. We will provide notice of any changes by posting the new Privacy Policy on the Company’s website. You are advised to consult this Privacy Policy regularly for any changes. If we make any material changes, we will notify you of such changes on our Site and/or through other appropriate methods.

The California Consumer Privacy Act (“CCPA”), provides California residents additional rights regarding the collection and use of Personal Information.

We collect personal information from multiple sources, including directly from you or your agent, from other individuals, service providers or other third-party vendors, publicly-available sources, consumer reporting agencies, government agencies, or other businesses.

We retain personal information according to our retention schedules, which are established by our business needs, along with legal and regulatory requirements.

Fairmatic collects personal and other information about you. Personal information (PI) is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with you. Other, non-personal information does not and cannot reveal an individual’s identity such as information that has been de-identified or aggregated. The information we collect varies based on what products and services you have with us.

In the preceding 12 months, we have collected and processed the following categories of information as enumerated in CCPA:

  • Identifiers, such as names, phone numbers, email addresses, online identifiers (such as IP address), social security numbers, driver’s license numbers, and other similar identifiers.
  • Characteristics of protected classifications under California or federal law, including gender and date of birth
  • Personal information as described in subdivision (e) of Section 1798.80 of the California Civil Code, such as signature, state identification card number, insurance policy number, billing address, bank account, and credit or debit card information.
  • Internet activity such as interactions with the Service website, email, or application
  • User content, such as Text, Photos, Videos, and Audio.

Fairmatic does not use or disclose sensitive personal information for any purpose not expressly permitted by the CCPA.

No sale of personal information

The California Consumer Privacy Act (CCPA) gives California residents the right to opt out of the “sale” or “sharing” of Personal Information. Fairmatic does not sell or share Personal Information in exchange for monetary consideration. We only share personal information as described in this policy.

No Discrimination

Fairmatic will not discriminate against you (for example, by denying goods or services or providing a different level or quality of goods or services) for exercising any of the rights afforded to you.

Right to Know

You have the right to request disclosure about what categories of personal information Fairmatic has sold or disclosed for a business purpose about you and the categories of third parties to whom the personal information was sold or disclosed. Additionally, you have the right to request the disclosure of specific pieces of information. Below is a full list of the information that you can include in your request.

  • The categories of sources from which the personal information was collected
